TRAINER CLIENT AGREEMENT

PERSONAL TRAINER & CLIENT AGREEMENT

This agreement is made between:


TAKE HEART FITNESS (‘the company’, ‘personal trainer’, ‘we’, ‘our’, ‘us’)


AND


YOUR NAME (‘the client’, ‘you’, ‘yours’)

Congratulations on your decision to improve your health and participate in our Programs! With the help of your personal trainer and/or registered dietician, you greatly improve your ability to accomplish your goals faster and safer. In order to maximize your progress, it will be necessary for you to follow the Program guidelines for the duration of the Program.


Please read the Trainer Client Agreement (“Agreement”) carefully. The following is an Agreement between you (“user”) and Take Heart Fitness (defined below), which governs your use of Program(s) (defined below) obtained by purchase through this website at www.takeheartfitness.com, or any related domains or subdomains (the “Sites”). 


“Program(s)” referred to by this agreement include but are not limited to: personal training programs, services, blog content, and any other documents provided for paid purchase or for which you supply personal information in exchange, including free downloaded material or other information available through the Sites, obtained from Take Heart Fitness. 


The purchase of Programs through Take Heart Fitness are subject to the following Agreement. All customers are advised to review these carefully before making any purchase through Take Heart Fitness.



APPOINTMENT/CONSULTATION CALLS

  1. Video calls/consultations (if applicable) that are not rescheduled or cancelled within 2 hours in advance will result in forfeiture of the consultation.

  2. Clients joining late to the call will receive the remaining scheduled session time.

  3. If the personal trainer cancels, you will receive an email stating the cancellation. If it is within 2 hours of the original scheduled time, then you will receive this service for free.

  4. Video consultations are not a therapy or consoling session.  


PAYMENT TERMS

  1. Programs are to be paid in full prior to receiving the Program.

  2. Each Excel Sheet, PDF download, or online content given for free or sold is for the use of you only. You are not allowed to copy, distribute, share and/or transfer the product/s you purchased to any third party or person.

  3. All transactions are made through payment gateways such as PayPal or Ascend that use SSL encryption. These payment gateways are safe and secure for using all types of credit cards and debit cards in different countries and your details are not stored during this process.

  4. By placing an order with Take Heart Fitness, you warrant that you are at least 18 years old, and accept this Agreement, which shall apply to all orders placed.


RETURN/REFUND POLICY

  1. All purchases made on www.takeheartfitness.com are non-refundable. Since the products made available here are intangible, we cannot accept any request for refunds.

  2. This unfortunately means we have a strict no refund policy in regards to dissatisfaction with product. Please contact us at takeheartfit@gmail.com to see how we can remedy any problems you may have with this.

  3. Please remember that it is your responsibility to download the Product immediately and save all purchases. Take Heart Fitness will, at your request, apply a one-time only $5.00 re-download fee per item if you request a new download link after a prior purchase, having otherwise misplaced the download link originally supplied by Take Heart Fitness. This fee will be paid through Ascend and a new link will be sent.
